If I had a bike that was new I would insist that they find out what was wrong. Call HD main office and talk to their teck dept. I have done this on several of the bikes that I own. Make some noise tell them you want another bike. One that runs the right way, tell them you been to the dealer how many times and still not fixed! You will get what you want and they will make every effort to fix it. If not go to the next step.
I had a problem that could not be fixed and I got them to take mine back under the lemon law. If it is not fixed by three times you can get your money back. Insist that they fix it or give your money back.
I've heard of the MoCo doing refunds of lemons before, sounds like you got one...
The gauges might be a problem so try switching them back first.
